Wrongful Death Lawyer

Wrongful death Lawsuits are filed based on a death that is caused by the wrongful act or negligence of another and gives the heirs basis to seek legal representation for a civil action against the party responsible for damages. Wrongful death Negligence is measured as in percentages. Negligence that is marked by conduct that presents an unreasonably high degree of risk to others and by a failure to exercise even the slightest care in protecting them from it and that is sometimes associated with conscious and willful indifference to their rights.

In approaching any reckless act committed by another directly and foreseeable resulting in the death of another, one must approach an analysis of it from the standpoint of ascertaining very basic questions surrounding the "wrong", if any, that was committed by the actor. The legal term "wrong" is defined by Black's Law Dictionary as "a violation of the legal rights of another; an invasion of right to the damage of the parties who suffer it, especially a tort. A tort is defined as a civil wrong as opposed toa criminal wrong as opposed to a criminal wrong. A wrong in this context signifies an injury to a person that results in death. Historically, wrongful death statutes are provisions which operate upon the common-law rule that the death of a human being may not be complained of as an injury in a civil court. The wrongdoeristhe one who commits an injury; atort-feasor. The term ordinarily imports an invasion ofa right or rights to the damage of the party who suffers such invasion. The cause of action for wrongful death is for the wrong to the beneficiaries. In other words, the deceased maintains no legal right in and of himself to recover for this wrongful death. An example of a wrongful death would include the death of a child who is drawn to an unenclosed swimming pool, falls in, and consequently drowns and dies. Automatically, there would be questions of wrongful conduct that resulted in the death of a child in this example. The analysis would include a definition of the legal concept of wrongful conduct which is defined as" conduct which contravenes some duty which law attaches to relation between parties affected.

The duty in our example includes having a swimming pool safely protected because of the foreseeable consequences of not having it so. In our example, the child was unimpeded, fell in, drowned and died. But for the wrongful conduct of not having erected a barrier, a fence or the like, the swimming pool would not have been accessible to the child and the child in this purest sense would not have drowned. The parents of the child would be the wronged parties and would have a right to civil remedy. The wrongful act which is basic to wrongful death is any act which in the ordinary course will infringe upon the right of another to his or her damage, unless it is done in the exercise of an equal or superior right. In our example, there would be no justification of the drowning unless the "owner" could establish to the court's satisfaction that he had failed to erect a fence or barrier to the pool in the exercise of an equal or superior right. A discussion of any circumstances covering possibilities of an exercise of an equal or superior right, in our swimming pool example, will be for later discussion, if any. Thank you.
